Effective Date: June 25, 2026
These Terms of Service ("Terms") are a legal agreement between you and Mahi Plumbing ("Mahi Plumbing," "we," "us," or "our") governing your access to and use of mahiplumbing.com (the "Website"), the content on it, and the online tools, forms, communications, and informational services we provide (together, the "Services"). The plumbing work we perform at your home is governed by the separate written estimate, work authorization, and invoice you sign or approve for that job (your "Service Agreement"); if anything in your Service Agreement conflicts with these Terms about that work, the Service Agreement controls for that work.
1. Acceptance & Eligibility
By accessing or using the Website or Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Website or Services. You represent that you are at least 18 years old, are a resident of the United States, and have the legal capacity to enter into these Terms. Our Services are intended for residential single-family homeowners (or their authorized representatives) located in our Texas service area; the Website is not intended for commercial customers.
2. Our Services
Mahi Plumbing provides residential plumbing services — such as plumbing repairs, drain and sewer service, water-heater repair and installation, fixture installation, repiping, gas lines, leak detection, and water filtration — to single-family homeowners throughout Greater Houston. We are a licensed plumbing contractor in Texas (Responsible Master Plumber License RMP 46529). Service availability, scheduling, arrival windows, and the scope of any particular job depend on your location, the conditions at your property, and the details of your request, and are confirmed in your Service Agreement. We may change, suspend, or discontinue any part of the Website or Services at any time without notice.
3. Website Content & AI / Automated Tools
The information on the Website — including service descriptions, articles, FAQs, glossary entries, and similar content — is provided for general informational purposes only. Some of this content is created, drafted, or assisted using artificial-intelligence and automated content tools (including third-party AI services such as Cortex AI) and may be reviewed by our team. AI-assisted and automated content may contain errors, omissions, or out-of-date information, and may not reflect the specific conditions at your property. We make no warranty that any content is accurate, complete, current, or suitable for your situation. You should not rely on Website content as a substitute for a professional, on-site assessment, and you use such content at your own risk. Some pages may also use automated chat or messaging features; responses generated by automated tools are not professional advice.
4. Estimates & Quotes
Any price, estimate, or quote provided through the Website, by phone, by text, or before an in-person evaluation is preliminary and non-binding. It is based on the information you provide and is offered only for general budgeting. A binding price and scope of work are established only in a written estimate or work authorization that you sign or approve in advance of the work (your Service Agreement). If conditions at your property differ from what was described, or if the scope changes once work begins, we will inform you and obtain your approval of any revised price before continuing. Promotions, coupons, and advertised pricing are subject to their stated terms, may not be combined, and may be changed or withdrawn at any time.
5. Pricing, Billing & Financing
Unless your Service Agreement states otherwise, payment is due upon completion of the work. We may require a deposit or diagnostic/trip fee for certain visits, which will be disclosed before the work. You agree to pay all amounts due for services you authorize, plus any applicable taxes. We do not collect or store full payment-card numbers on this Website; card payments are processed by a third-party payment processor through its own secure systems, subject to its terms. If you choose to apply for financing, financing is provided by a third-party lender under that lender's separate application, terms, rates, and approval criteria; Mahi Plumbing does not make credit decisions and is not the lender, and approval is not guaranteed.
6. No Professional Advice
Content on the Website is general information about plumbing topics and is not professional, engineering, legal, financial, or other advice for your specific situation, and it does not create a contractor-client relationship. Plumbing conditions vary from home to home, and attempting work based on general information can be dangerous and may violate code or void warranties. Always obtain a professional, on-site evaluation before acting. For any active leak, gas odor, sewage backup, or other emergency, stop and contact a qualified professional or the appropriate emergency authorities immediately.
7. Intellectual Property & Limited License
The Website and its content — including text, graphics, logos, the Mahi Plumbing name and mascot, images, layout, and design — are owned by Mahi Plumbing or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Website for your own non-commercial purpose of learning about and engaging our Services. You may not copy, reproduce, republish, distribute, modify, frame, scrape, harvest, or create derivative works from the Website or its content, and you may not use the Website or its content to train, develop, or improve any machine-learning or artificial-intelligence model, in each case without our prior written permission. All rights not expressly granted are reserved.
8. Acceptable Use
You agree that you will not, and will not permit anyone else to:
- use the Website or Services for any unlawful, fraudulent, or harmful purpose, or in violation of these Terms;
- submit false, misleading, or unauthorized information, or impersonate any person or entity;
- upload or transmit viruses, malware, or other harmful code, or attempt to gain unauthorized access to the Website, our systems, or other users' data;
- interfere with or disrupt the Website, servers, or networks, or bypass any security or access controls;
- use any robot, spider, scraper, or automated means to access, copy, or collect content or data from the Website without our written permission; or
- infringe the intellectual-property or privacy rights of Mahi Plumbing or any third party.
9. Your Submissions
If you submit information, photos, reviews, comments, or other content to us (a "Submission"), you represent that you have the right to do so and that your Submission is accurate and lawful. You should not include sensitive personal information in a Submission. You grant Mahi Plumbing a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display Submissions in connection with operating and promoting our business (for example, displaying a review), unless prohibited by law. We are not obligated to use or keep any Submission and may remove content at our discretion. Reviews and testimonials reflect individual experiences and are not a guarantee of any particular result.
10. Third-Party Services & Links
The Website may include links to, or embedded tools from, third parties — such as online booking (Jobber), maps, analytics, financing applications, payment processing, review platforms, and social media. We do not control and are not responsible for third-party services, their content, or their privacy and security practices, and your use of them is governed by their own terms and policies. Your dealings with any third party are solely between you and that third party.
11. Disclaimers — "AS IS"
THE WEBSITE, ITS CONTENT, AND THE ONLINE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, Mahi Plumbing disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement, and any warranty that the Website will be uninterrupted, secure, error-free, or free of viruses or other harmful components. We do not warrant that any information on the Website is accurate, complete, reliable, or current.
This Section concerns the Website and online content. The terms, warranties, or guarantees (if any) that apply to the physical plumbing work we perform are set out in your written Service Agreement; manufacturer warranties on parts and equipment, if any, are passed through to you per the manufacturer's terms. Nothing on the Website is a promise or warranty of any particular outcome. Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MAHI PLUMBING AND ITS OWNER, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, arising out of or relating to your access to or use of (or inability to use) the Website, its content, or the online Services, whether based on contract, tort, negligence, strict liability, or any other theory, even if we have been advised of the possibility of such damages.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE WEBSITE, ITS CONTENT, AND THE ONLINE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO MAHI PLUMBING FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
These limitations apply to the Website and online Services. Liability arising from the physical plumbing work performed at your property is addressed by your written Service Agreement and applicable Texas law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including liability for fraud, gross negligence, willful misconduct, or personal injury caused by our negligence. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless Mahi Plumbing and its owner, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Website or Services; (b) your violation of these Terms or any applicable law; (c) your Submissions or any content you provide; or (d) your violation of the rights of any third party. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.
14. Dispute Resolution — Binding Arbitration & Class-Action Waiver
Please read this Section carefully — it affects your legal rights, including your right to go to court and to participate in a class action.
Informal resolution first. Most concerns can be resolved quickly. Before starting an arbitration, you agree to first contact us through our contact form or by calling (832) 844-6244 and give us at least 30 days to resolve the dispute informally.
Binding arbitration. If we cannot resolve the dispute informally, you and Mahi Plumbing agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Website, our content, our marketing or text-message communications, or the Services (to the fullest extent permitted by law) will be resolved by final and binding individual arbitration, rather than in court, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration will take place in or near Brazoria County, Texas, or by remote means, and judgment on the award may be entered in any court of competent jurisdiction. This agreement to arbitrate is governed by the Federal Arbitration Act.
Class-action waiver. You and Mahi Plumbing agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of a representative or class proceeding.
Exceptions. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive or equitable relief in court to protect its intellectual-property rights or to stop unauthorized use of the Website.
Your right to opt out. You may opt out of this arbitration and class-action-waiver agreement by sending written notice through our contact form with your name and the words "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out will not affect any other part of these Terms.
15. Governing Law & Venue
These Terms and any dispute arising out of or relating to them or the Website are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Subject to the arbitration agreement above, you agree that any claim not subject to arbitration will be brought exclusively in the state or federal courts located in Brazoria County, Texas, and you consent to the personal jurisdiction and venue of those courts.
16. Termination
We may suspend or terminate your access to the Website or Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may stop using the Website at any time. Provisions that by their nature should survive termination — including intellectual-property, disclaimer, limitation-of-liability, indemnification, arbitration, and governing-law provisions — will survive.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page, and the updated Terms become effective when posted. Your continued use of the Website after an update means you accept the revised Terms. If you do not agree to the changes, stop using the Website.
18. Miscellaneous
These Terms, together with our Privacy Policy and any Service Agreement, are the entire agreement between you and Mahi Plumbing regarding the Website and online Services, and supersede any prior understandings on that subject. If any provision is found unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of our business. We are not liable for any delay or failure to perform caused by events beyond our reasonable control. Notices to you may be provided through the Website or the contact information you give us.
US State Privacy Rights
If you are a California resident, you have rights under the CCPA/CPRA regarding your personal information, including the right to opt out of the sale or sharing of personal information, and residents of other US states may have similar rights under their state privacy laws. Please see the "Your Privacy Choices" section of our Privacy Policy — also reachable via the "Do Not Sell or Share My Personal Information" link in the footer — for the categories of information we collect, your rights, and how to exercise them.
